Privacy Policy

1. Who’s Who

Friendly Tickets is referred to by name or “We”. When this Privacy Policy uses the term “Producer”, we mean event producers using Friendly Tickets to create events for ticket buyers or ticket registrants. Ticket Buyers and third parties using Friendly Tickets to either purchase a ticket for an event or register for an event are all referred to in these Terms collectively as “Buyers”, “Buyer”, “You”, or “Your”. Producers and Buyers are collectively referred to as “User” and “Users”.

2. Information Collected From Users

From all Users, we may collect Personal Data, which is voluntarily provided in order to use Friendly Tickets for inquiring on, listing, producing, registering, transferring, or buying tickets related to events listed in Friendly Tickets. We may also receive Personal Data from third party sources, such as other Users, social media, our payment processing partners, or other third parties. The Personal Data collected may include without limitation names, email addresses, phone numbers, physical addresses, or any other information that Users or third party sources choose to provide, which may cause Users to be personally identified. In addition, Producers can set up event registration pages to collect virtually any information that the Buyer may choose to provide. Friendly Tickets does not control the Personal Data that Producers may collect from Buyers. Additionally, Friendly Tickets may collect Personal Data from Buyers on behalf of a Producer. When You register for an event with, or otherwise provide information to, Friendly Tickets in conjunction with an event or activity, whether that information is Yours or a third party’s, in connection with a purchase, registration, or transfer, Friendly Tickets and the Producer will receive and may use the information provided.

3. Financial Information

Friendly Tickets does not store identifing credit card numbers. Identifying credit card information is stored with our payment processing partners, for example Stripe and Authorize.Net. In order to buy a ticket on Friendly Tickets, Buyers will need to provide financial information (e.g. credit card numbers and expiration dates, billing addresses), some of which may constitute Personal Data.

4. Personal Data Usage

We collect and use Personal Data in a manner that is consistent with this Privacy Policy and applicable privacy laws. We may use the Personal Data as follows: If You provide Personal Data for a certain purpose, we may use the Personal Data in connection with the purpose for which it was provided. For instance, if You contact us by email, we will use the Personal Data You provide to answer Your question or resolve Your problem and will respond to the email address from which the contact came. Additionally, if You registered, signed up for, added Yourself to a list, or made a purchase for an event on Friendly Tickets, Your email address is available to the relevant Producer and Friendly Tickets.

5. Disclosure of Personal Data

Friendly Tickets will not sell Your Personal Data. We consider this information to be a vital part of our relationship with all Users. Therefore, we will not sell Personal Data to third parties, including third party advertisers. There are certain circumstances in which we may disclose, transfer, or share Personal Data between Buyers and Producers without further notice, as set forth in this Privacy Policy.

6. Producer Use of Personal Data

When a Buyer registers for an event, signs up for communications, adds themselves to a list, or otherwise inputs Personal Data (such as through a web form) to communicate with a Producer or Friendly Tickets in order to participate in an event, the Producer and Friendly Tickets will receive and may use that information. The Producer may send marketing or other communications, which may be subject to its own separate privacy policy. Likewise, if a Buyer provides a phone number, then messages related to the service, event, activity, or information in which the Buyer expressed an interest, may be sent by the Producer and Friendly Tickets.

7. How We Store Your Personal Data

Friendly Tickets may store Personal Data, and such information may be stored by third parties to whom we have transferred it in accordance with this Privacy Policy. We take what we believe to be reasonable steps to protect the Personal Data collected via Friendly Tickets from loss, misuse, unauthorized use, access, inadvertent disclosure, alteration, and destruction. However, no network, server, database, or Internet or email transmission is ever fully secure or error free. Therefore, Users should take special care in deciding what information is sent electronically. Please keep this in mind when disclosing any Personal Data. We retain Your Personal Data for as long as necessary to provide You with our services, or for other important purposes such as complying with legal obligations, resolving disputes, and enforcing our agreements.

Assumption of Risks by You and Disclaimer of Warranties

1. Assumption of Risk

You understand and agree that some events may carry inherent risk, and by participating in those events, You choose to assume those risks voluntarily. For example, some events may carry risk of illness, bodily injury, disability, or death, and You freely and willfully assume those risks by choosing to participate in those events.

2. Disclaimer of Warranties

You agree that to the extent permitted by applicable laws, the services offered by Friendly Tickets are provided on an “as is” and “as available” basis. Friendly Tickets expressly disclaims all warranties of any kind, expressed or implied, including, but not limited to, implied warranties of merchantability, title, non-infringement, and fitness for a particular purpose.

3. Acknowledgement

You acknowledge that Friendly Tickets has no control over and does not guarantee the quality, safety, accuracy, or legality of any content associated with an event, the truth or accuracy of any information provided by Producers (including the Buyer's personal information shared with Producers in connection with events). Friendly Tickets has no responsibility to You for, and hereby disclaims all liability arising from, the acts or omissions of any third parties that Friendly Tickets requires to provide services, that a Producer chooses to assist with an event, or that You choose to contract with when using Friendly Tickets.

Release and Indemnification / Limitation of Liability Agreement

1. Release

You hereby agree to release Friendly Tickets from all damages (whether direct, indirect, incidental, consequential, or otherwise), losses, liabilities, costs, and expenses of every kind and nature, known and unknown, arising out of a dispute between You and an Event Producer, or a third party in connection with Friendly Tickets. In addition, You waive any applicable law or statute, which says, in substance: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM MUST HAVE MATERIALLY AFFECTED HIS SETTLEMENT WITH THE RELEASED PARTY.”

2. Indemnification

You agree to defend, indemnify, and hold Friendly Tickets, and its affiliates and subsidiaries, and, as applicable, each of its respective officers, directors, agents, co-branders, licensors, payment processing partners, other partners, and employees, harmless from any and all damage (whether direct, indirect, incidental, consequential, or otherwise), injury, loss, liability, cost, and expense (including, without limitation, reasonable attorneys’ and accounting fees) resulting from any claim, demand, suit, proceeding (whether before an arbitrator, court, mediator, or otherwise), or investigation made by any third party due to or arising out of (a) Your improper use of Friendly Tickets services, (b) Your breach of any applicable local, state, provincial, national, or other law, rule or regulation, or the rights of any third party, (c) any incidents occurring at an event listed with Friendly Tickets, or the fact that Friendly Tickets was providing services with respect to those events. This indemnification shall not apply to the extent that a claim arises out of Friendly Tickets’ gross negligence or willful misconduct.

3. Limitation of Liability

You agree that to the extent permitted by applicable laws, or as otherwise set forth herein, Friendly Tickets, and any person or entity associated with Friendly Tickets (e.g., an affiliate, vendor, strategic partner, or employee), will not be liable to You or any third party, for any indirect, incidental, special, consequential, punitive, or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data, opportunity costs, intangible losses, or the cost of substitute services (even if Friendly Tickets has been advised of the possibility of such damages), or Your content. Nothing in these Terms is intended to exclude or limit any condition, warranty, right, or liability which may not be lawfully excluded or limited.
